A Northland man found guilty of a murder that was recorded on sound tape has lost his appeal against conviction.
David Soren Bradley, 30, of Pakotai was refused legal aid for a lawyer to present his appeal but filed "lengthy" written submissions anyway.
Delivering the judgment of the Court of Appeal this week, Justice Gault said there was ample evidence for the jury to find murderous intent and that both self-defence and provocation were ruled out.
The court rejected grounds of appeal alleging the judge had made wrong rulings and comments during the trial, that the prosecutor had acted inappropriately, and that Bradley was not tried without undue delay.
In November Bradley was sentenced to life imprisonment for the murder of Hamilton man Michael Potopoto Ormsby, 58, on New Year's Day 1994. Mr Ormsby was a friend of Bradley's uncle, and became involved in a dispute between the aunt and uncle, the court heard. The uncle and Mr Ormsby arrived at the aunt's home late at night, abused the occupants and broke some windows. In a later fight, which the aunt recorded on sound tape, Mr Ormsby was killed.
