That both defendants had relevant previous convictions showed they were slow learners, Judge Macdonald said when two Mosgiel men appeared. However, the matters bringing them for sentence happened last April and they had not offended since.
Matthew John Leith Deuster (25), sickness beneficiary, and Glenn James Casey (21), car painter, had a Crimes Act charge of assaulting Jeffrey Silber. Deuster had further admitted a Crimes Act assault on Correen Donaldson.
The incident occurred when a car in which Deuster and Casey were passengers left the Bowling Green Hotel car park, about 11.45pm on April 21. A queue of patrons was partially blocking the driveway. After passing through, the pair got out and confronted Mr Silber, accusing him of hitting their car.
When Ms Donaldson intervened and told them nobody wanted to fight, Deuster grabbed her around the throat and pushed her out of the way. Both men then assaulted Mr Silber, resulting in him needing three stitches for a cut to his scalp. He also received a cut to the back of his head, a chipped tooth and an abrasion to his forehead.
Deuster and Casey were both “finally warned”, and, for the assault on Mr Silber, sentenced to 200 hours community work. Deuster’s assault on Ms Donaldson brought 50 hours community work, concurrent.
