A feud between two families led to a number of disputes between members of each family - ending with two people being shot at. Cowan Nathan McIntosh, 16, and Lionel Teweno Chicoine appeared in the High Court at Rotorua yesterday for sentencing on two charges each of wounding with intent to cause grievous bodily harm and one each of possession of a firearm. Justice Patrick Keane threw out one charge each of attempted murder. McIntosh was sentenced to four years six months in jail and Chicoine was sentenced to five years and three months in jail.

The charges relate to an incident on July 12 last year when Chicoine and McIntosh in a car chased brothers Harmyn and Edward MacPherson. Chicoine was driving and McIntosh fired three shots towards the brothers' utility vehicle. One of the brothers suffered injuries to his arm and chin while the other brother lost two fingers from the shooting. Representing McIntosh, Jonathan Temm said there was a history between the offenders and the victims. He said McIntosh was normally of good character and the incident wasn't a planned attack.

"This is really hot-blooded, lack of thought offending," Mr Temm said. Appearing for Chicoine, Harry Edward said there had been a feud between the MacPherson family and Chicoine's family, which had since been sorted out by Chicoine's father. He said when the incident happened, Mr Edward told the court Chicoine didn't have his father around. If he had been around, Mr Edward said it would never had happened. Mr Edward said the incident was "out of character" for Chicoine. Appearing for the Crown was Sarah-Louise Wootton who submitted the offenders should be treated equally for their involvement in the incident.

Justice Keane said there were a number of incidents involving the victims, leading up to the final one where they were shot at. He said the first involved one of the MacPherson brothers leaving skids on a lawn of a relative of Chicoine's with a farm bike. Chicoine and the relative then went to the MacPherson house and drove into the farm bike. They armed themselves with a metal bar and a golf club and the MacPherson family armed themselves with weapons such as an axe and a shovel, Justice Keane said. Chicoine suffered an injury to his arm when one of the MacPherson brothers hit the bar out of his hand with a shovel.

Chicoine then picked up McIntosh and went to an associate's home to get a rifle and ammunition, Justice Keane said. He said Chicoine followed the MacPherson brothers, driving up beside them before McIntosh fired. This happened three times. Justice Keane sentenced McIntosh to four years six months in jail on the wounding with intent to cause grievous bodily harm charges and 18 months on the lesser charge. The sentence was to be served concurrently. Chicoine was sentenced to five years and three months in jail on the wounding with intent to cause grievous bodily harm charges and 18 months on the lesser charge, which was to be served concurrently also.
