A man found guilty of assault for smacking his four year old son is no stranger to violence. New Plymouth labourere Pieter Donselaar has three known assault convictions - including one in which he head-butted his partner twice and rubbed a dirty nappy in her face.

He was jailed for three months on that charge. Last week Donselaar tried to use Section 59 of the Crimes Act - which allows a parent to smack a child provided the force is reasonable and used honestly for correction - as a defence to assault charges after he smacked his child twice for "pooing his pants".

After a two-day trial in the High Court at New Plymouth, the jury returned a guilty verdict. But it took four hours deliberation before the jury decided the blows, which left extensive bruises on the boy's legs, were unreasonable. Children's rights advocates believe the case highlights the need for repealing Section 59. They say it has been used to allow people with violent histories like Donselaar to get away with child abuse.
