Background
NZ Lawyer 10th November 2006
A teenager has admitted raping a 85-year-old woman in a Dunedin home invasion. Ashwin Ellis, 18 and unemployed, was arrested after the September 19 home invasion in which the elderly woman was left bound and gagged in her Pine Hill house. He yesterday pleaded guilty to five charges, including rape, when he appeared in the Dunedin District Court. The guilty pleas were for rape, injuring with intent to aid sexual violation, two charges of sexual violation by unlawful sexual connection, and threatening to do grievous bodily harm.
At the request of his lawyer Campbell Savage, Ellis was remanded for two weeks for police to consult the Crown and consider resolution of five other charges from the incident. Those allegations are two of burglary, attempted rape, attempted sexual violation, and detaining the woman with intent to have sexual connection. An 11th charge from the incident, of sexually violating a female, was withdrawn on the application of prosecutor Sergeant Chris George. The summary of facts was not read to the court yesterday. It would be held until Ellis' next appearance, on November 23, Judge Stephen O'Driscoll said. Ellis has been in custody since his arrest about five hours after the woman was found bound and gagged, and remains there.
