As Moana Herewini drove drunk, fast and dangerously in a car he knew had faulty brakes, his two mates urged him to let them out. Instead, the 27-year-old continued to speed along Racecourse Rd, north of Cambridge, before losing control at an intersection and crashing into a tree. Herewini's "best mate" Kyle Douglas, 20, suffered massive head injuries in the crash and died four days later on July 31, 2007. His second passenger suffered serious injuries, including a broken leg and arm.
Herewini has been sentenced at the High Court in Hamilton to 7 years six months jail after pleading guilty to manslaughter, reckless driving causing injury and driving with excess blood alcohol. Justice Andrews also imposed a non-parole period of three years and nine months. After the crash, Herewini was taken to Waikato Hospital and gave a reading of 89 milligrams of alcohol per 100 millilitres of blood. The legal limit is 80mg. It was estimated that at the time of the crash his level would have been between 125155mg.
Herewini initially denied being the driver, telling police the vehicle was driven by a hitch-hiking Black Power member who ran off after the crash. However, he later told police he had been drinking and smoking cannabis before getting behind the wheel and knew the car's brakes were faulty. In a pre-sentence report, Herewini said he was so drunk he couldn't remember the crash. He was assessed at being at high risk of reoffending. Justice Andrews said she agreed with Crown prosecutor Jacinda Foster's submission that "the only thing that was going to make you stop that night was the crash that eventually did stop you, killed your friend and seriously injured your other friend." The judge disqualified Herewini from driving for four years upon his release from prison.
