THREE of seven men accused of kidnapping and seriously assaulting a man have been found guilty. A fourth man has been found guilty of one charge of kidnapping the man while the remaining three men walked free from the High Court at Rotorua yesterday following a two- and-a-half week trial.

All faced two charges of kidnapping, except Daniel Alexander Noanoa, 31, Ngongotaha, unemployed, who had faced one charge of kidnapping. All seven men faced charges of injuring with intent to cause grievous bodily harm, conspiracy to murder and an alternative charge of threatening to kill.

Dick Tamai, 27, Ngongotaha; David Vincent Hill, 27, of Rotorua and Luther Lloyd Toleafoa, 27, childcare worker, Mamaku, were found guilty of two charges of kidnapping and a charge of injuring with intent to cause grievous bodily harm at Rotorua on August 7 last year. They were found not guilty of conspiracy to murder and threatening to kill.

Jeffrey Maraenui Irving, 28, Rotorua, unemployed, was found guilty of one charge of kidnapping and not guilty of the remaining four charges. Jason Wayne Batt, 27, bushman, Rotorua; George Paul Tamai, 26, Ngongotaha, childcare worker, and Noanoa walked free after being found not guilty on all five charges.

The Crown case was that the complainant, whose name is suppressed, was forced into a van and punched and kicked as he was driven to Ngongotaha. The Crown says he was assaulted again, had guns pointed at him, was tied up, put in a car boot and driven to a garage in Monokia St. There he was again tied up and put in another car boot, from which he later escaped.

The jury retired to consider its verdict at 2pm on Tuesday. They spent that night together in a hotel and delivered their verdicts at 5pm yesterday. Yesterday morning one of the jurors was excused after becoming unwell.

Before the remaining 11 jurors came back with their verdicts Justice Rayner Asher requested the more than 30 supporters in the back of the court receive the verdicts in silence, saying that if there were any significant disturbances they would be asked to leave. There was high security with at least 10 police officers in the public gallery but there were no outbursts as the verdicts were read out.

The three men, who were found not guilty of all charges, shook the hands of their co-accused before leaving the courtroom with one of the free men hugging and thanking his lawyer. Justice Asher remanded Dick Tamai, Hill, Tuleafoa and Irving in custody for sentencing on October 27.
