Two 19-year-old men will each go to jail for five years for the aggravated robbery of Denny's Restaurant. Jacob Joseph Scanlan and Warren Miles Joseph, both unemployed, got away with $16,478. Only $5075 was recovered. Both men were also charged with unlawfully taking a motor vehicle. They had previously pleaded guilty to the charges. Judge Colin Doherty said Joseph was a former employee of Denny's. In November, the men stole a vehicle, and armed with an air pistol and baseball bat, went to Denny's at 5am, when they knew all the takings for the night would be on the premises. Four staff were present. Joseph pointed the pistol and threatened to blow a staff member's head off, Judge Doherty said.

Scanlan slammed the bat down near the head of a staff member. Judge Doherty said a probation report on Joseph, a first offender, showed he had severe alcohol and drug dependency. He had previously been suspended by Denny's. He knew how the system at the restaurant worked, and saw an opportunity to get over his financial difficulties. Scanlan had had a hard upbringing, had severe substance dependencies, and might have some mental health problems, he said. Judge Doherty refused defence counsel Shaun O'Neil's request to treat Joseph more leniently. Mr O'Neil represented both defendants. The men were jailed for five years for aggravated robbery and two years for car theft. The sentences will run concurrently. Judge Doherty said stealing cars for use in an aggravated robbery would not be tolerated.
