Background
The Nelson Mail. September 26th, 2007
A Motueka man who pinned his partner to the floor with his knee on her
neck and threatened to kill her as she held a young baby will remain behind bars
until he is sentenced next month.
Warren Kahukura, 46, admitted charges of threatening to kill and one of assaulting a female when he appeared in the Nelson District Court yesterday Police prosecutor Sergeant Chris Stringer said Kahukura was at home with his de facto partner and their young child on September 19. He had drunk eight cans of beer, and became angry when the baby began crying.
He pushed his partner to the floor, then pinned her down by putting his knee on her neck and his hand over her nose and mouth so she could not breathe. Mr Stringer said the victim thought she was going to die. Kahukura got off her, then forced her to the floor again with the baby in her arms, and told her she was going to die.
Defence lawyer Michael Vesty asked Kahukura to be considered for restorative justice, but Judge Paul Whitehead said the "issues of power and control'' and the level of violence shown meant this was not a suitable option. Kahukura had previous convictions for assaulting a female and a conviction for rape, the judge said.
He refused to grant Kahukura bail, and remanded him in custody until October 24 while pre-sentence, emotional harm and victim impact reports are prepared.
