A convicted robber and fraudster has had his minimum period of imprisonment shortened on appeal. Joshua Mason Kite pleaded guilty to three charges of aggravated robberies, six of using and four of attempting to use a document to obtain pecuniary advantage and one of escaping from custody. He was originally sentenced to 11 years and eight months' imprisonment with the right to apply for parole in eight years. The charges relate to three major armed robberies in Auckland in late 2006 in which he and his associates made away with over $230,000 and to Kite's use of stolen credit cards in July 2006 to the value of nearly $5000.

Then in January this year Kite managed to trick court staff and escape from custody. Kite appealed his sentence on several grounds including the high starting point, having cumulative sentences and an erroneous minimum non-parole period. The three-judge bench of the Court of Appeal today agreed with Kite only on the last point. They lessened his minimum non-parole period to six years and eight months in line with previous rulings.
