When Mario George Lilley raped an 18-year-old this year while on bail it was "a callous act of indifference", said Judge Robert Spear. In the Hamilton District Court yesterday Lilley, an unemployed 26- year-old, was sentenced to six years' jail for aggravated burglary, four years' prison for injuring with intent to injure and five years' jail for sexual violation by rape. The six and four year terms are concurrent, the rape term cumulative. The court heard that Lilley raped while on bail after being charged with attacking a 41-year-old man.
Defence lawyer Sean Ellis said Lilley had been sexually abused at home since the age of 8 and was also a victim. "Sexual matters have been cheapened for Lilley. So has violence," he said. The court heard yesterday how Lilley had woken up to find someone touching him around the genitals when staying at a flat during April. Later he smashed the window of the victim's flat, climbed into the house and beat the complainant with fists, kicked him with boots and hit him with a glass handle.
Said Judge Spear: "The complainant is not injured in a way that had caused him permanent disability, but it could easily be otherwise."Initially Lilley denied these charges, but on October 29 when the jury trial was to start, he changed his plea. The court heard how during August, when Lilley was on bail, he raped a teenager. He was "cuddling up" to the woman, who had been drinking, then removed her lower clothing after she had fallen asleep.
Judge Spear said he needed to send a clear message that such "appalling behaviour" would not be tolerated. "It was a callous act of indifference on your part to her," Judge Spear said. Mr Ellis said Lilley was deeply remorseful. Prosecuting, Janine Bonifant said in April Lilley committed a deliberate and violent attack. "it was a home invasion", she said. The rape victim did not encourage Lilley in any way. The event had left her fearful of men.
