A Masterton man has been sentenced to eight years in jail for breaking into the home of a 74 year old woman and raping her. In the High court at Wellington , Justice Doogue Sean Grayson Lusty was a danger to the public because he was unaware of his crime. Lusty continued to deny that he was the offender in the face of almost insurmountable scientific evidence, the judge said. He recommended that Lust be psychologically or psychiatrically assessed. He said the victim, a widow who lived alone was courageous and dignified. A jury last month found Lusty guilty of breaking into her home and raping her.
Justice Doogue sentenced Lusty to concurrent terms of eight years for rape and five years for burglary. Lusty, aged 28, a sickness beneficiary had pleaded not guilty to the offence which happened in Masterton on March 27 last year. The main evidence against him was that his DNA Profile matched DNA from sperm collected from the victim. A scientist said the sperm was more likely to come from lusty than any other unrelated individual selected at random. Justice Doogue said the jury had to reject Lusty's defence.
Found guilty of breaking into the home of a 74 year old amputee widow and raping her. The victim said she could not identify her attacker who had let himself into her home at about 4 AM using keys she had left in her car in an unlocked garage. Lusty had been to her house previously, knew in which room she slept, and lived in the same area.
