In the Auckland High Court, Justice Wylie said Mahutoto and the victim had been in a relationship and resided with each other but the relationship had broken off 10 days prior to the offence. Mahutoto took the victim away without her consent and beat her after she banged on the car windows trying get assistance for a passerby. In the Auckland District Court, Judge Doogue issued Mahutoto with a warning under the new "three strikes" law.
