A man who robbed a prostitute and tried to rape a young woman he met after a night out has been jailed. Julius John Marsters, 38, who admitted a charge of robbery and was found guilty by a jury of assault with intent to commit sexual violation, was jailed for five and a half years by Justice Fogarty in the High Court in Christchurch. Marsters, 38, was found by police in Australia, where he had fled on bail for the crimes, which date back to the late 1990s.

His Honour said Marsters was an intelligent person who went to considerable lengths to avoid responsibility. "I think you are the sort of person the community fears." A Christchurch street prostitute was robbed when Marsters put his knee on her back, emptied her handbag and ran off. Seven months later, he met a young woman after a night out in central Christchurch, gained her confidence and offered to take her home. But Marsters drove to Mairehau, where he pulled her out of the car, dragged her through a fence into a paddock, held her down and started sexual contact.

"It has to be a nightmare scenario for a young woman in that situation," His Honour said. He said the woman was quick- witted enough to pretend she was consenting and asked Marsters to get a condom. When Marsters went back to the car, she ran away. She was later forced to go through the ordeal of a trial. "Not only did the victim go through hell in the trial having to relive the events, but when the whole thing is recharacterised by you giving evidence it was just a misunderstanding, that adds further insult," His Honour said.

"You showed in the way you conducted your defence and gave evidence you had a callous disregard for the feelings of the victim of attempted rape." His Honour said he saw similar conduct in both events, and had earlier called for a psychiatric report, which confirmed Marsters had severe behavioural problems at the time, with a risk of reoffending. Prostitutes were vulnerable and were as entitled to protection as others working at night. Marsters had written letters of remorse, but His Honour gave them little weight. It was clear that in absconding on bail Marsters had done his best to avoid trial.

Counsel Tim Fournier said the offending was at the lower level for both types of case. No high level of violence existed, and no weapon was used. Marsters had solid family support and a good work record, and was a candidate for rehabilitation, which would return him as a productive member of the community, Fournier said. Prosecutor Craig Ruane said reports noted a moderate to high risk of reoffending and an avoidance of accepting responsibility for the offending. His Honour called for an assessment for psychiatric treatment while Marsters was in jail.

A man wanted for serious sexual offences has sparked a manhunt after breaking his bail conditions and failing to appear in the Christchurch High Court. Sergeant Derek Shaw said yesterday Julius Marsters, 34, was considered a danger to the community. "We are concerned that the longer he's at large, the greater the likelihood of him reoffending," he said. He could not discuss the details of Marsters' offending because the case was coming before the courts. Mr Shaw said Marsters might be in Christchurch, where he had family, or he may have travelled to the Nelson area. Marsters was caucasian, 186cm tall, with dark hair and tanned skin. Anyone who knew of Marsters' whereabouts should not approach him, but should contact the police immediately.
