Background
NZ Lawyer 8th March 2007
An Auckland prostitute who attacked a client during an argument over a transaction has successfully appealed the length of her jail term. Raewyn Rosita Matthews, then 34, was sentenced in Auckland District Court in April, 2006, to three years' jail for the attack. The court was told Matthews was picked up by the client and driven to a secluded area in Grey Lynn. There an argument developed. The man said in evidence he didn't want to go ahead with the transaction. Matthews said the row was over price and the use of a condom. She assaulted the man, stabbing him in the back four times with a sharp object. He bled profusely and needed medical attention.
Matthews' lawyer Ron Mansfield appealed to the Court of Appeal against conviction and the length of the jail term. He submitted the judge did not take into account the vulnerability of the woman in the car and redeeming features in a pre-sentence report, He also said Matthews, who had previously been jailed for assault with intent, was taking steps to address her violence. The Court of Appeal agreed the jail sentence was too severe and reduced it to two years and four months but dismissed the appeal against conviction.
