A Christchurch man who raped at knifepoint a prostitute who was nearly six months pregnant has been jailed for 8 years six months. At the High Court in Christchurch yesterday, Justice Panckhurst said that Donald Clifford McMillan, 38, would be sentenced to preventive detention if he offended again. McMillan picked up the woman from Manchester Street six days before Christmas last year, wanting sex for $80. She later told the police she was financially desperate and had turned to the streets to make money, despite her advanced pregnancy. She was raped on her second night out.
She had arranged a secluded yard for business, a venue her minder knew about.
However, McMillan drove her to another place and raped her at knifepoint. As he drove her back to where he met her, she had the foresight to put a ring under the car seat, intending to use it to identify him as her attacker, Justice Panckhurst said. She reported the rape to the police, but they could not find the car.
The following night, when she went back with her minder to warn other street workers, she saw McMillan pick up another prostitute. The police found him a few days later. Justice Panckhurst said McMillan's offending had been arrogant.
McMillan was deported from Australia because of his criminal convictions. His previous convictions included indecent assault. "I was concerned by the manner in which you gave evidence,'' Justice Panckhurst said. ``It impressed me as flat, unemotional, and calculating." A probation report indicated that McMillan led a solitary existence, and was a complex individual.
After the court case, Detective Pat Mulrooney said that three men had recently been prosecuted for raping prostitutes. This case stood out because the woman had gone straight to the police to report the rape. ``There must be many complaints that never come to police,'' he said. McMillan had said in his defence that he took back the $80 after finding out that she was pregnant because he was disgusted she would be on the streets at that stage, he said.
