Background
Manawatu Standard story here
An elderly man currently in jail for sexual offences against a 14-year-old has had his sentence doubled after it was found he raped the same girl. Leslie John Miller, 74, was sentenced to 12 years' imprisonment for two counts of rape in the Palmerston North District Court yesterday. He was 70 years old at the time of the offence. His sentence was to be served concurrently with a 6 year 6 month sentence already imposed for four sexual offences against the girl, who was known to him.
Defence lawyer Andru Isac told the court Miller had fathered 11 children over seven decades and was a respected man. If a minimum non-parole period was imposed, it could be considered a life sentence for the ageing man, he said. Judge Alastair Garland said each rape charge carried a maximum penalty of 20 years' imprisonment. The offending against the young victim occurred over about three to four years, during which time he threatened her against telling anyone about the encounters.
But in May 2006 she told a school friend about what he had been doing to her. He denied the offending and said the girl was lying when he was questioned by police, Judge Garland said. A report showed that Miller had no motivation to address his offending. He was a "mature man" committing "escalating sexual abuse" against a vulnerable young girl, the judge said.
The victim was now emotionally scarred and unable to maintain normal relationships, often resorting to self harm, the court heard. The offending interfered with her schooling and "messed up her life". "The only way that you can be held accountable properly for harm to the victim and the community is for you to serve a reasonably substantial portion of your sentence." A minimum non-parole period of six years was imposed.
From the Manawatu Standard 20th March 2008
A 72-year-old Tararua sex offender was sent to prison yesterday for six and a
half years. The man can be named as Leslie Miller after the complainant
consented to having name suppression lifted. A Palmerston North jury last month
found Miller guilty of three counts of indecent assault and one of sexual
violation against a young woman. The same jury acquitted Miller of two charges
of sexual violation and indecent assault. The offending took place between 2001
and 2006 when the girl was aged between 10 and 14. Miller, faces a retrial in
September on two other charges. Other details relating to the case were
suppressed by Judge Nevin Dawson.
