The court of Appeal has refused to lower the eight year jail term given to Philip Paul Rakete for the manslaughter of his de facto wife's three year old son Jordan Ashby. The sentence was well within the range available to the sentencing judge, the court decided. Rakete, aged 23, pleaded guilty late last year to the manslaughter of Jordan Ashby by punching the child and hitting him with a belt after he soiled his pants. There was also evidence Rakete was addicted to marijuana and was suffering from a short fuse because he was not able to get supplies.
Giving the range of the courts decision, Justice McKay said the Delcelia Witika appeal, and sentences for fatal child beating would reflect individual circumstances. In this instance, though it had not been proved that Rakete used a metal-studded belt to beat Jordan , the injuries the child suffered on his chest, back and buttocks were consistent with a metal-studded belt being used.
