Bashing a 74-year-old with a brick has earned a Huntly man three years and two months in jail. Ernest Rawiri, a 34-year-old unemployed man had pleaded guilty to a charge of aggravated robbery at an earlier appearance and was sentenced yesterday at Hamilton District Court. The charge relates to an incident on January 23 when Rawiri approached the victim from behind and bashed him twice over the head with a brick.
When the man turned around Rawiri punched him in the face, knocking him to the ground and demanding money. After taking some cash Rawiri rode off on his bicycle. Defence counsel Mike McIvor said while Rawiri has been in prison he has realised that he had worked for the victim in the past and now his father was employed in a part-time capacity by him. As a sign of his remorse Rawiri had written a letter to the man and the courts. The victim had previously declined a restorative justice meeting.
Mr McIvor said Rawiri was distressed that his 16-year-old son was leaving for Australia that day when he came across the man. He said that while there was an element of premeditation, it was mostly an opportunistic crime, driven by the fact that Rawiri could not afford to go with his son. In a twist of fate Rawiri managed to get the money together to get to Auckland but missed the plane. Judge Joanna Maze said he had a long history of offending and she doubted that he was ready to change.
