A KNIFE-WIELDING man who tried to rob a dairy in Tahunanui before holding up the Mobil Service Station in the suburb has been jailed for five years and three months. Hayden Peter Smith, 33, was sentenced in the Nelson District Court yesterday after earlier admitting one charge of aggravated robbery and one charge of attempted aggravated robbery.
The police summary said that on July 14 at 6.42pm Smith entered the Suburban Dairy on the corner of Green St and Tahunanui Dr. His face was covered by a ripped T-shirt made into a balaclava, and he was holding a large black- handled chef's knife with a 23cm blade. Terrence Sharpe was working alone in his shop and managed to escape to the store's rear, where he activated an alarm. Smith left empty-handed in his car, but his actions were caught on video camera. Smith crashed his car a few minutes later.
About 10 minutes later Smith walked into the Mobil Service Station in Tahunanui Dr, this time without his face covered, and confronted the attendant, Ry Koleff, brandishing the knife at him and demanding money. Fearing for his life, Mr Koleff opened the till and handed over $497 and Smith ran off. Later that night police, helped by the public, found Smith's car in Bridge St, Nelson. Smith was arrested as he returned to the vehicle.
The balaclava used in the first robbery and the knife used in both were found in the car and $180 cash was strewn about the interior. Smith made partial admissions when he was arrested but said the next day, during police video interviews, he had very little recollection of his actions the night before because he was so drunk. He said the reason he carried out the robberies was because he needed money to get back to his home in Southland.
Judge Zohrab said when sentencing Smith that he had a disturbingly similar conviction for stealing $910 by threatening a service station proprietor with a claw hammer. Judge Zohrab said since that earlier offending, which Smith had been jailed for, he had been offered help, but was back in court for the same kind of offending. Judge Zohrab ordered Smith to pay $317 in reparation at $20 a week on his release from prison.
