Te Huia broke into the home of a Mt Maunganui woman, who was asleep, and hacked her with an axe before sexually assaulting her. Earlier in the evening he had broken into the home and stolen some trivial items. He returned armed with an axe and when he realised the woman was upstairs sleeping he became violent, hitting he over the head several times, then dragging her from her bed and removing her clothing.
