Background

Tenboom and Phillips abducted the girl from a street in Mangere. The offenders pulled her jacket over her head to prevent her from identifying them and where they were taking her. Both men raped her, punched her, kicked her and threatened her with a knife. The offenders then insisted she repeat to them an assertion that she had been attacked by members of the Highway 61 gang. The complainant had been hit on the head when at first she refused to repeat the statement.

Mr Justice Thompkins described it as a "particularly savage and callous" rape committed on an innocent girl who had been treated in an extraordinarily humiliating and vicious manner and forced into the stolen station wagon kicking and screaming. The judge said the complainant had suffered numerous injuries and was scarred physically and "highly likely, scarred emotionally for the rest of her life." Crown prosecutor Mr Roy Ladd said the rape stood out to be one of the worst in recent years.
