A man who kidnapped and sexually assaulted a woman at Tiwai, near Bluff, last year had a 30 year history of sexual offending. Athol Trevor Waters, aged 50, was sentenced to preventive detention with a minimum parole period of 10 years for unlawful sexual connection on February 23, 2004. Waters was also sentenced for kidnapping and indecent assault. Justice John Fogarty said in the High Court in Invercargill on Thursday Waters’ previous sexual convictions, which included two for rape and one for attempted rape, meant such a sentence was inevitable.
Waters‘ lack of remorse and the fact he still denied the offences occurred were aggravating features, he said. Waters was warned in 1994, when he was sentenced to 10 years in jail for rape, that he was "on the verge" of preventive detention, Justice Fogarty said. Waters was convicted of rape in 1984 and 1994 attempted rape in 1985 and in 1972 was sentenced for having sex with a girl aged between 12 and 16. Waters had 50 convictions, including six for sexual offences, Justice Fogarty said.
Defence counsel David Slater argued waters’ offending was not as bad as offences he committed in the past. Those involved a high level of violence that was absent in this case, he said. Crown Prosecutor Mary Jane Thomas said Waters’ "horrific past" and likelihood of reoffending when released meant he must be kept in prison for as long as the law allowed. His past offending included cruelty and "severe violence" to his victims, she said. Waters was also convicted of kidnapping, for which he was sentenced to 10 years imprisonment, and indecent assault, for which he received five years. The sentences are to be served concurrently.
