Blind loyalty landed Jeremy Phillips in jail. Yesterday in the High Court at Hamilton, Phillips, 37, was jailed for more than five years for a New Year's Eve assault on three people at Whitianga nearly two years ago. Kandy Emeline Joyce Wati, 30, beneficiary, was sentenced to community work for her part in the attack. But Justice Robert Fisher told Phillips it was simply luck that he was not facing a conviction for homicide.

The court heard how Phillips, a Whangaparaoa builder, armed himself with an iron bar and a fishing knife before returning to the New Year's party, where a friend had been punched earlier in the night after refusing to leave. The court heard it was Phillips who suggested that he, Wati and the friend return to the party to "smash them". Phillips' assaults left one victim with concussion, another with stab wounds to his head, chest and neck that required stitches and left him out of work for six months. His third victim needed dental work to repair broken teeth.

Wati's victim was scratched across the face. Crown prosecutor Rowan Butler pointed to the probation report which said loyalty, a propensity for violence and an alcohol problem were behind the offending. Justice Fisher said despite the rather "gloomy" assessment he took a more positive view and he had the impression Phillips had the qualities to "step above all this". He sentenced Phillips to five years and three months' jail on a charge of wounding with intent to cause grievous bodily harm, assault and two charges of assault with a weapon. Wati was sentenced to 200 hours of community work on an assault charge.
