THE attempted sexual violation of a boy represented a gross abuse of power and trust, Judge Phil Moran said when passing sentence in the Invercargill District Court yesterday.John Boyd Adams, 47, a language teacher, was sentenced to two and a half years' jail for indecent assault on a boy aged between 12 and 16, inducing that boy to do an indecent act on him, and attempted sexual violation.
The charges, to which Adams had pleaded guilty, related to one incident on July 28. Defence counsel Fergus More said Adams was helping the boy through a difficult period in his life. He was drunk at the time and his actions that night had been to show the boy he was grown up -- "in order for the boy to appreciate that he does have his manlihood," Mr More said.
"That is seen from his perspective as part of a way of developing the boy." Psychological reports showed evidence of Adams having "historical matters" that might have influenced his behaviour that night, Mr More said. He had also pleaded guilty at the first opportunity, sparing the complainant the need to give evidence in court. "He takes his shame and he accepts the punishment that's due him," Mr More said.
Judge Moran said Adams' intoxication was no defence and he rejected any suggestion that this incident was to show the boy's manliness. "You don't demonstrate manliness by sexual abuse," he said. He noted the boy now suffered from, and was taking medication for, mild depression. However, he accepted the actions were out of character and Adams showed no predisposition towards paedophilia.
