Background
Waikato Times, Saturday, 20 September 2008
A Hamilton man who approached a 15-year-old girl asking for her phone number and then groped her, has been jailed for 10 months. Jade Akuhiata August, 33, appeared in the Hamilton District Court for sentencing yesterday after pleading guilty to a charge of indecent assault on a female under the age of 16.
The court heard that on December 7 last year, August approached a 15-year-old girl in Hamilton's Garden Place about 5.40pm, and asked for her phone number. August, who was described as moderately intoxicated at the time, told the girl that he had no friends. He then grabbed the girl, and started rubbing her back and buttocks. The victim broke free and called police.
The court heard that August had 28 previous convictions, including one in 2001 for indecent assault. Defence counsel Bruce Hesketh said August's offending was a result of alcohol abuse and he was a different person when sober. Judge Merelina Burnett said August's latest offence had happened while he was serving a sentence of community work and supervision. Judge Burnett noted a pre-sentence report which said August was at risk of reoffending and sentenced him to 10 months' prison.
