A 42-YEAR-OLD man, who indecently assaulted a 14-year-old girl, was jailed for four years yesterday when he appeared before Judge Phil Moran in the Invercargill District Court. Stewart Alexander James Balloch, labourer, had earlier admitted six charges of indecent assault on the girl, including one of digital penetration, between July 2 and 8 and between September 22 and 28. Judge Moran said an aggravating feature of the offences was Balloch's abuse of power because he was someone the girl should have been able to trust.
The touching offences and digital penetration on July 8 were outrageously flagrant because they were done in the presence of other adults but in such a way that they could not see what was happening. Effects on the victim were likely to be profound and she was already having problems handling the attentions of boys. Balloch had other convictions for sexual offences and had previously been sentenced to 15 months' jail, Judge Moran said. "Sadly you have failed to heed those lessons," he said. "Sadly you still deny full culpability. "You minimise your actions and blame the victim for leading you on and that, Mr Balloch, is disgraceful." Jail was necessary to help ensure the safety of other young girls in the community, he said.
