A sleeping woman was sexually violated while her partner lay alongside her, a Wellington District Court judge has been told.
Wellington man Mark Richard Barber's remorse was genuine, despite the victim's doubts, defence lawyer Bruce Davidson
said in court yesterday. The woman woke to find Barber touching her intimately. Judge Tony Adeane jailed Barber for one year
and nine months on the charge of sexual violation by unlawful sexual connection.
Barber, 29, a forecourt attendant, pleaded guilty to the July 13 offence. He'd been drinking heavily, the court heard. Prosecutor Alysha McClintock said Barber betrayed the victim's trust. She'd allowed him to move in with her and her partner when he was having domestic problems. Judge Adeane said Barber could apply for home detention. He also disqualified Barber from driving for 12 months on a charge of driving with excess blood alcohol.
