Background
From the Daily News 8th July 2005
A Stratford chef who sexually abused a girl in her own home had a high risk of reoffending, Judge Louis Bidois said in the New Plymouth District Court yesterday. Eric John Barriball (51) was jailed for four and-a-half years after earlier admitting masturbating in front of the girl in Stratford on November 7, and having unlawful sexual connection with her on November 27. He must serve a minimum two-thirds of the sentence.
Initially, Barriball denied the charges, but he pleaded guilty on the morning of the June 20 trial. Yesterday, Judge Bidois said Barriball had earlier been convicted of two separate sex charges, and a psychologist who interviewed Barriball classed him as a high-risk reoffender. However, Barriball had admitted he had a problem and was willing to seek help, Judge Bidois said.
The court heard Barriball had been invited to the girl's house on November 7 by her parents who were supporting him because he felt lonely. Barriball was operating Play Station late at night, but left the lounge and went into the girl's room and masturbated. It was dark but the girl knew what he was doing and told her sister, who told her parents once Barriball had left. The allegations were later denied by Barriball. "Unbelievably, you were able to return to the house," Judge Bidois said.
Barriball was again using Play Station in the lounge late at night. About 11.30pm the girl's parents went to bed and Barriball was about to leave. However, he went into the girl's room while she was sleeping and violated her by unlawful sexual connection.
The girl woke up and screamed, and Barriball offered her money if she kept quiet about the incident. "Fortunately, she had the courage and the support of her family to tell, and you are now held accountable," Judge Bidois said. A victim impact statement showed the victim had lost her confidence, could hardly sleep, and feared for her safety, he said.
From the Daily News 16 December 2000
A New Plymouth chef has been sent to jail for 15 months for indecently assaulting a nine-year-old girl. Eric John Barriball (46) appeared in the New Plymouth District Court yesterday for sentence on the January 5 incident. Barriball was found guilty of assaulting the girl, who had stayed at his home. Crown prosecutor Rebecca Mann told the court the assault had been a serious breach of trust by Barriball who had shown no remorse.
Defence counsel Andrew Laurenson said the offending had been on the lower end of the scale and asked that the sentence reflect that. Judge Christopher Harding told the court Barriball had two previous convictions for sexual offences. "Although this offending was brief, it has had a high effect on the young girl and her family."
