Background
A health report assessed Brown as having a "high risk of sexual recidivism". The Chief Executive of the Department of Corrections applied for an ESO but this was rejected by Judge Dawson in the Wanganui District Court in July 2005. The Crown successfully appealed Judge Dawson's refusal to make the order in December 2005.
