Man guilty of abuse may not go to jail
A man convicted of sodomising a child in a bout of teen-boy paedophilia 40 years ago may escape being sent to jail as a result of a sentence imposed in the High Court in Napier yesterday. Facing four charges of sodomy and one of indecent assault, Roger George Dick, 56 of Napier, was sentenced by Justice Dennis Clifford to 15 months in prison.
But the start of the sentence was deferred for up to two months to enable him to apply to serve it on home detention, and he was released on continued bail. The charges related to offences in Waipawa from 1966 to 1969, starting when Dick was 15 and his victim was aged nine.
The judge conceded there were difficulties deciding on a sentence, when the maximum available penalty for sodomy based on legislation at the time the offences were committed was seven years in jail. Had it been under current legislation, Dick would have been charged with sexual violation and been liable to a maximum sentence of 20 years.
Justice Clifford had to take into account Dick's age at the time, and other background which included that Dick had also been abused by a paedophile in the years before. In setting the length of the term, he could not take into significant account later offences by Dick on other victims, although he did note a "pattern continued by subsequent offending." The defendant had been convicted for sexual offending as recently as 1995.
Dick, whose surname was changed from Smith after his parents seperated when he was a child, had originally denied the latest offences, but pleaded guilty last month on the day his victim was to give evidence in a trial. Justice Clifford told Dick the victim was hurt by the offences, was too scared and ashamed to tell, and had suffered numerous problems, including psychiatric difficulties and hallucinations "which he attributes to what you did to him." A woman who had know Dick since he was a child told Hawke's Bay Today outside the court that others Dick had offended against, including her own daughters, had also been through lives of dysfunction and trauma.

A Napier man pleaded guilty to charges of sodomising a young boy 40 years ago. Roger George Dick, 54, was due to be trialled in the High court in Napier but decided to plead guilty to the four charges of sodomy on young boys and one of indecently assaulting a boy.
The offences happened in the late 1960's, mainly in Hawkes Bay but also in Rotorua, starting when Dick was 15 and the boy who was assaulted was aged under 10. Dick will be sentenced in Napier on November 10.
