A 27-YEAR-OLD man who broke into a girls' hostel and tried to kiss a minor was handed a total jail term of two years and one month when he was sentenced in the Invercargill District Court yesterday. Adam John Hamilton appeared before Judge Kevin Phillips for sentencing for indecent assault and burglary on June
13 and driving while disqualified, driving with a breath alcohol level of 950mcg and carrying an air pistol for an unlawful purpose on January 23.
Judge Phillips told Hamilton his offending caused him "great concern", quoting his pre-sentence report. "I believe you have mental health issues, which you fail to confront.... you say things about working when you are not; you say things about being in a gang when you are not." Turning to the drink-driving offence, he said Hamilton had justified his breath alcohol level by saying he had taken over the driving of the car "to save a friend's life".
On being stopped by police in Alexandra, he had produced a replica Glock air pistol and said to the officer, "I better show you this". The break-in at the Southland Girls' High School hostel on Enwood Lane happened while he was on bail for the earlier offending, Judge Phillips said. Highly intoxicated, Hamilton went into the room of two 15-year-old girls. He sat on one of the girls' beds and tried to kiss her before being pushed away. Hamilton then tried the same thing with a 12-year-old girl in another room, Judge Phillips said.
Later, when questioned by police, Hamilton had said, "I am a f**king male, what do you think I'm doing here?", the judge said. Adopting the burglary charge as the "head offence", Judge Phillips sentenced Hamilton to two years and one month's jail. For the indecent assault, he sentenced him to to a further 12 month's jail, to be served concurrently. For both driving offences, he sentenced him to concurrent terms of one year's jail on each and disqualified from driving for 18 months on both. For the air pistol offence, he sentenced him to three months' jail, also concurrent.
