Background
From the Nelson Mail 4th April 2009
A Nelson man who put a woman through a "sustained and prolonged" sexual attack last year has been jailed for eight years. Jesse Arthur Heke, 24, was sentenced by Judge Bruce Davidson in the Nelson District Court yesterday on seven charges which were laid after the "violent" sexual attack on the 21-year-old woman, whom he had known for some time, at a Nelson hostel last year.
Heke was convicted of one charge of rape, two charges of unlawful sexual connection, two charges of assaulting a female and one charge of injuring with intent to injure. Heke was also convicted and discharged for threatening behaviour. Heke had pleaded guilty to the charges. Heke and the victim moved to Nelson last year. In June, Heke was arrested and charged with threatening behaviour and released on bail on the condition he not offer violence to the victim.
In July, Heke invited the victim to a hostel he was staying at so she could help him with his computer. When the victim arrived, Heke started "pestering" her before arguing with her over phone numbers stored in her mobile phone. Judge Davidson said Heke then began to "get physical" with his victim, pushing and kicking her and then dragging her by the clothing when she tried to crawl away. He then sexually violated her twice.
Heke then banged the victim's head against the wall and she lost consciousness. When she regained consciousness, Heke put her on the bed and raped her. "By this stage she was your total prisoner, or putty in your hands," Judge Davidson said. The next day, the victim went to hospital with scratches and bruising to her hands, head and face.
Judge Davidson said the victim impact statement showed the woman had been "physically, physiologically and emotionally" affected. "What the long-term effects will be are hard to say, but it's well known that such incidents cause distressing long-term effects."
Heke's age, limited previous convictions, guilty pleas and ability to hold down a stable job were mitigating factors in the sentencing, Judge Davidson said. Heke had accepted that he needed treatment for anger and violence, and with support from his family, could possibly be rehabilitated, Judge Davidson said.
