A man who sodomised a wheel-chair bound woman during a "brutal and bestial" attack has been jailed for 11 years. In the High Court at Hamilton, Justice Hammond said Jason Brent Kelly, aged 22, was "perhaps the most explicit it has been my misfortune to preside over." Kelly sodomised his 20 year old victim and forced her to perform oral sex on him for a period of over several hours after the pair, who were casual acquaintances, met at city pub last May. The woman who was in court yesterday for Kelly's sentencing suffers from muscular dystrophy.
She said during the trail in February that Kelly abandoned her on a Hamilton street in the early hours of the morning after the attack. She was stranded because the batteries of her electric wheel-chair had gone flat. A jury found Kelly guilty of two counts of sexual violation and one of indecent assault, but was unable to reach a verdict on a fourth count of rape. Justice Hammond said Kelly had preyed on the woman, who had put her trust in him. He had subjected her to a brutal and bestial sexual ordeal which had harmed her physically and mentally.
"She now leads a much more restricted and fearful life." He said Kelly used his trail to attack the woman's credibility, but the jury had not been convinced. He had claimed that the woman had consented sex and wanted it "hard and fast." "You cast foul aspirations against the complainant which blew up in your face. You have to take the consequences for that." Justice Hammond said a psychiatrists report indicated that Kelly had not shown remorse and did not accept his behaviour was deviant.
