Background
From Otago Daily Times June 2004
A teenager was warned by Judge Gary MacAskill in the Alexandra District Court yesterday he had to learn to be responsible. Stephen John Livett (18), unemployed, of Alexandra, admitted a charge of having sexual intercourse with a girl under 16 in Alexandra on April 22. In March, he had been fined $600 for having sex with a minor. The charge admitted yesterday was not related to the same girl.
Crown counsel David Robinson said after the first offence Livett had been given a stern warning, yet had still offended. He said there needed to be a deterrent sentence, as Livett was targeting young, immature females. He asked for a sentence of between six and 12 months jail. Defence counsel Kieran Tohill said Livett had health problems and was on drugs to combat problems such as bipolar disorder. He said the girl involved in the April offence had supplied condoms and it was consensual sex.
Judge MacAskill said he had decided not to send Livett to jail, instead sentencing him to 200 hours community work and supervision for nine months. He also ordered him to carry out an anger management course and psychological tests as ordered by the probation service. Livett also admitted three charges of assaulting a female, arising from an incident between March 1 and April 7 this year. On each of these charges, he was sentenced to 100 hours community work, the terms to be concurrent. Judge MacAskill warned Livett that if he failed to do the community work, he would end up in jail.
