Background
The Dominion Post 20th September 2007
A Taupo electrician has been jailed for eight years for raping a woman after a night of passion turned sour.
Gary MacGregor-Dunn, 37, was found guilty in August by a Rotorua District Court jury of sexual violation, kidnapping, threatening to kill and assaulting a female at the victim's home in February last year. At sentencing yesterday, Judge Chris McGuire said that in the week leading up to the offending, the couple had consensual sex regularly at the victim's house. On the night of the offending, MacGregor-Dunn had gone to the victim's house to cook dinner. The pair had consensual sex and after consuming a lot of alcohol the mood of the night turned sour when the victim told MacGregor-Dunn she wanted to end the relationship.
He became angry and was asked to leave but refused. He kept the victim in a bedroom, where they had sex, abused her verbally, and unplugged the phone so she could not call for help. He threatened to kill her and then himself. The victim fainted at one stage in the toilet. MacGregor-Dunn had stuck his fist, then a duvet, in her mouth to stop her from screaming. She suffered bruising to her arms, body and neck, had not been able to work for a week and attended counselling since the attack, the court was told.
Police arrived at 3am after they were alerted by a friend of the victim who the victim had managed to ring from a cellphone. She told police later she thought she would die. Defence lawyer Jonathon Briscoe said the couple had a strong sexual attraction to each other. He said the victim had exaggerated her injuries and did not appear traumatised.
