THE Supreme Court has refused to hear an attack on the legality of the open-ended sentence of preventive detention. Lawyers for two men serving the sentence wanted to argue nine points about it, including whether it was lawful and whether it should have been imposed on the men. Three judges in the Supreme Court said that the issue about the legality of the sentence was not arguable and no other issues were raised that were necessary in the interests of justice for the court to hear. One of the men, Damon John Exley, was sentenced in June last year for the attempted robbery and rape of a real estate agent in Plimmerton. He had more than 200 previous convictions. The other, Ian Kenneth McMillan, was sentenced to preventive detention in 1995 for child sex offences.
