A Gate Pa pensioner who molested a girl has been jailed for 10 months. Colin Mikaere, 59, was sentenced in
Tauranga District Court yesterday after having earlier pleaded guilty to one charge of indecent assault on a female
aged 12-16 years. The offence was committed in July and August, last year. Crown prosecutor Sharee Christensen
told Judge Peter Rollo the Crown opposed home detention because of the need for a deterrent sentence and accountability
reasons.
Lawyer Craig Tuck told Judge Rollo that his client's doctor had set out his health concern about Mikaere who was clearly seriously unwell. Mr Tuck said his client's offending had had somewhat of a dramatic impact on all concerned, something that would stay with Mikaere for the rest of his life. Mr Tuck said Mikaere had apologised and pleaded guilty as soon as possible. He urged the judge to consider home detention given Mikaere's ongoing health issues, his remorse and attitude.
Judge Rollo said, while it was accepted the assault was a one-off incident and Mikaere immediately apologised and expressed remorse, the offending involved a gross breach of trust. "The message from the court must be that young girls must be protected from the predatory sexual acts of older males," the judge said. On his release from prison, Mikaere will be subject to six months of release conditions which include not associating with anyone aged under 16 without adult supervision and the approval of the probation service.
