A 15 year old schoolgirl has told the Christchurch District Court that her friend was "out of it" from smoking cannabis when she had sex with a man she had met just a few hours earlier.
Crown prosecutor Kerry White said Miller approached a 14 year old girl when she was walking to the netball courts in Hagley Park on the afternoon of May 12. He befiended her and asked her to come for a ride in his car to Lyttelton. She agreed, and they drove to Godley Head where they smoked cannabis in his parked car.
"The defendant blocked out the windows (using a sunshield) and told the complainant to lie back and relax. Then he had sexual intercourse with her," Ms White said. A school friend of the 14 year old complainant said Miller had told her friend he was 21 years old and was "really nice to her."
Asked by Ms White what her friend said had happened in Miller's car, the witness said: "She was kind've out of it and he raped her. Then she told him to take her home."

Former Nelson social worker Scott James Miller has admitted two sex charges involving 15 year old girls. He admitted charges of having sexual intercourse with one 15 year old and indecently assaulting the other. He was a social worker for the Child, Youth and Family Service.
Sergeant Dave Jory said Miller had met one complainant in Takaka and had corresponded with her by letter, phone and email for two months. They met in his hotel room where he kissed her and tried to undress her before she stopped him. At a later meeting he did undress her, and induced her to touch him.
The other complainant had visited Miller in his hotel room, where he had performed oral sex on her and had intercourse. When four girls visited him, Miller offered them cannabis.

Former Nelson social worker Scott James Miller has been jailed for 2 1/2 years after admitting sex charges involving girls under 16. He had also admitted offering to supply cannabis to a group of four 15 year old girls, and another charge of supplying a Class C drug.
In the Christchurch District Court yesterday, Judge Colin Doherty said he regarded the offending as predatory, especially in light of Miller's employment, and an element of deterrence was needed. It was a calculated course of conduct, preying on impressionable young girls :"You were in a position to know full well that your behaviour was inappropriate."
