A Convicted rapist faced abuse from one of his victim's associates yesterday when he left the New Plymouth District Court to serve almost 10 years in prison.
Danny Wackroe Mooney (31), of North Taranaki, was yelled and sworn at while being led from the court after taking a quick look at his victim sitting in the public gallery. Just moments earlier, he had been sentenced to nine years, 11 months' jail by Judge Chris Harding after a jury found him guilty of seven charges in the district court earlier this month.
Mooney had denied raping his former partner, performing oral sex on her and the aggravated burglary of her home last October 14; and four breaches of a protection order on October 3, 9, 11 and 14. On the charge of rape, Mooney was sentenced to nine-and-a-half years in prison, for the sexual violation charge he was given nine years' jail and seven years in prison for aggravated burglary - all to be served concurrently. For the first protection order breach, he was sentenced to one month in prison, two months' jail for each of the second and third breach - all three to be served back-to-back - and two months in prison for the fourth breach - to be served at the same time as the rest of the sentence.
The court heard how Mooney had broken into his former partner's home at night, armed with a knife, took her from her bedroom into the lounge where the sexual violation and rape took place. At the time, Mooney had threatened a "hit" on the victim's friend. Although his ex-partner had consented to sex, it had been out of fear, Judge Harding said. He said the victim was in fear of Mooney at the time of the rape, in fear of him during the trial and, according to the victim impact statement, she was still living in fear of him.
