A Porirua man was yesterday sentenced to 19 months in jail for indecently assaulting and attempting to have sex with a 14-year-old Rotorua girl. Peter Niko was 28 when he committed the crimes in January 2005. He had a family-like relationship with the girl and took advantage of her trust in him, Wellington District Court Judge Tony Zohrab said in handing down the sentence. "Twenty-eight-year-old males are supposed to look out for 14-year-old girls and not prey upon them," Judge Zohrab told Niko.
Niko was given credit for pleading guilty to the charges of indecent assault and attempted unlawful sexual intercourse with an underage girl. But Judge Zohrab said Niko's guilty pleas had come late in the case, after the girl had suffered the "indignity" of being cross-examined about an alleged incident of having sex in a public toilet. The fact that Niko had been drinking before the incidents, which included touching the girl's breast with his mouth, was not a mitigating factor, the judge said. Judge Zohrab also expressed concern that Niko's actions had come close to attempted rape of the girl, though he acknowledged Niko had not pleaded guilty to that crime. Niko had originally been charged with attempted rape. The judge gave Niko leave to apply for home detention before the man was led off to prison.
