An Auckland paedophile with 20 convictions for sex offences against teenage boys has had his indefinite jail term overturned on appeal. A six-year jail term replaced preventive detention, an indefinite term from which parole was not available until at least 10 years had been served.

Ian Charles Phipps, 45, had first been convicted of indecent assault on a boy in 1979. A string of offences followed up to February 1994 when Phipps met a 13-year-old boy in a public toilet. Police spoke to Phipps as part of an operation targeting homosexual paedophiles frequenting the toilet. Phipps eventually pleaded guilty to one charge of indecently assaulting a boy aged 13-14, representing a number of incidents between February 1994 and August 1995.

A District Court judge declined jurisdiction and Phipps was sentenced in the High Court to preventive detention. The Court of Appeal was told Phipps was at risk of further "non- coercive" sexual activity. The risk of Phipps reoffending was not so great and the type of crime he committed not so serious that a sentence of last resort was needed, the Court of Appeal said.
