A young girl "was not slow in coming forward," a New Plymouth man said in confessing to police that he indecently assaulted her, the New Plymouth District Court was told yesterday. But Mark Riley, 43, could not live with what he did and handed himself in, the court was told during his sentencing. He admitted the four indecent assaults, which occurred over a fortnight last year, telling police he had gone too far.
Defence counsel Andrew Laurenson said Riley was extremely remorseful and had not tried to minimise his offending. Riley had been frank with his family and colleagues and was deeply ashamed. The accused's fall from grace was significant as he had a previously unblemished record, his counsel said. Judge Allan Roberts said Riley had told the authorities that the little girl "knew what she was doing" and "was not slow in coming forward".
The judge dismissed the comment that the girl was sexually aware as "a nonsense and an attempt to shift responsibility". Riley averted a two-year prison sentence with his confession to police and his blame-free past. "But this was serious offending," Judge Roberts said, handing down a 15-month sentence. Special six-month release conditions include not having any contact with the victim and no unsupervised contact with any child aged under 16 years. Riley was also ordered to undergo psychological assessment and counselling.
