Crown prosecutor Simon Heale asked the judge for a sentence of preventive detention, saying aggravating factors included threats of violence, use of a weapon and offences committed while the offender was on bail. Justice Venning rejected preventive detention because of the lack of extensive criminal history and any evidence that he would reoffend on release.
