An Upper Hutt man was jailed for nine years yesterday for the rape of a teenage girl in the back of a car in May. Vailima Seiuli, 21, of Upper Hutt, had been found guilty, after a trial, of sexual violation by rape of a 17-year-old on May 26. Wellington District Court Judge Marion Frater said Seiuli had met the victim at Lower Hutt District Court and given her a ride home. Later that day he met her and a friend walking home from a service station. She said Seiuli and his friend invited the victim and her friend for a ride. For three hours they rode around until running out of petrol on the Hutt motorway. They had been drinking beer and whisky.
Judge Frater said the victim's friend went to get petrol and the victim lay down on the back seat. Seiuli joined her. She said that at first there was a bit of horseplay then the mood changed and he forced himself on her. The victim began screaming and called out for help to Seiuli's friend but after trying to help he got scared and left. The victim told a driver who stopped to help that she had been raped. Seiuli initially denied everything but later told police they had sex but it was consensual. Judge Frater said the victim's screaming left no doubt that she wanted to stop. Her hair was pulled out, at one stage Seiuli had twisted her neck as though he was strangling her, and she was left with bruising on her face, arms and legs. She said Seiuli had other violent convictions for assault, assault with intent to injure and injuring with intent.
Seiuli's excessive consumption of alcohol was part of his problem and though he had been alcohol-free for nine months, it was more because he was in custody than any conscious decision on his part, she said. Seiuli had also pleaded guilty to driving while disqualified. Judge Frater sentenced him to a six-month concurrent jail term and disqualified him for one year. Defence counsel Paul Paino said there had initially been some consent to sexual activity but things had gone too far. He said alcohol was a factor in all Seiuli's violent offending but he had no previous convictions of a sexual nature. Mr Paino said the victim had been understandably traumatised but some of the problems in the victim impact report had been in evidence before the attack.
