A man who tied the wrists of an intoxicated young mother and raped her has been
jailed for 10 years. Christchurch District Court Judge Phil Moran yesterday decided the usual tariff
for defended rape of eight years was not enough for Ricky John Seller, 36. The judge said Seller's
continued denials raised an issue of public safety. The charge of rape was a sinister addition to Seller's extensive criminal history.
He did serious harm to the complainant, then aged 18. "She says you did not just rape her body, you raped her soul and took her spirit away," the judge said. On October 16, 2005, the victim had gone out drinking with friends. She got drunk and after problems at the tavern, Seller offered her a ride home, and she showed her gratitude by a display of affection. However, at a service station, she told the attendant she was seriously concerned, and then inexplicably got back in the car with Seller.
He stopped at a remote country area where, over her protests and attempts to escape, she was raped. Seller then said he wanted to take her to his place "to finish the job". On arrival, she was very distressed and was taken home by a female relative of Seller, who insisted on going along too. She complained to her family and the police were called.
Seller claimed nothing happened, but the evidence of torn clothing and DNA contradicted that, the judge said. The victim's vulnerability was aggravating, as was her young age, that she had no means to go home from the tavern, and that Seller effectively enticed her into his car.
Violence was used which was above that inherent in rape, including tying her wrists and threatening to hit her if she resisted. She had previously been a happy young mother, but he had effectively destroyed her life, to the point she had suicidal thoughts and was on medication for anxiety and depression. A man, who was jailed for 10 years for tying the wrists of an intoxicated young mother and violating her, has received more jail time on unrelated charges. Ricky John Seller, 37, was jailed for a further 10 months last week by Judge David Holderness on 14 charges which included three of theft, five of obtaining by deception, failing to disclose ACC payments, making a false statement and three of interfering with cars. Seller, who defended the charge of rape, was jailed for 10 years in May, the judge noting his denials raised an issue of public safety.
On Friday, the judge said the offending for which Seller was sentenced occurred in various parts of the country, starting on a farm in Southland where he had stolen from his employer. His other crimes included obtaining credit in a false name, operating a fraudulent account on TradeMe, and receiving benefit overpayments. The judge said Seller had a "formidable" list of prior convictions, going back to the Youth Court. He continued to regularly offend, culminating in the sentence of 10 years for rape, which he was currently appealing against.
