A former care giver jailed for sexually abusing a handicapped teenager has asked an appeal court to grant home detention.
Rex Graham Stewart, 48, a former justice of the peace, was sentenced to two years in prison in the High Court at New Plymouth, in December. He had pleaded guilty on the second day of his trial to three charges of exploiting a significantly impaired person.
Justice Ronald Young said his preying on the vulnerable victim in his care was a gross breach of trust. Yesterday his lawyer, Julian Hannam, appealed the length of the sentence in the Court of Appeal at Auckland . He also sought home detention. Stewart was initially charged with multiple counts of sexual violation. But after hearing evidence from the victim, the Crown reduced the charges to three counts of sexual assault. Mr Hannam said Stewart had offered to plead guilty to the lesser charges before the start of the hearing but the Crown insisted on going to trial.
Justice Young did not properly take into account his early willingness to plead guilty, he said. Stewart was in charge of the 18-year-old handicapped youth who had the mental age of a six to eight-year-old old, when he took photographs of the teenager's genitals, touched his genitals and got the victim to take photographs of his genitals. Yesterday Justices Bruce Robertson, John Gendall and Patrick Keane reserved their decision.
