Mohi-Tewara and Tawha picked up the intoxicated Huntly schoolgirl from a party in the early hours of the morning. The offenders drove to Lake Waahi Reserve where they parked on the boat ramp. Mohi-Tewara got the girl from the car and on to a nearby table where he digitally penetrated her. Mohi-Tewara then told Tawha the girl wanted a "threesome". Tawha digitally penetrated her while Mohi-Tewara had oral intercourse with her.

Tawha realised the victim was in no state to consent and refused to join Mohi-Tewara in any further sexual activity. After the victim fell off the table Mohi-Tewara raped and sodomised the girl. Mohi-Tewara told Tawha he needed lubrication to sodomise her. Tawha then got a bottle of drink from the car and poured over the victim's backside.
