Vakavelo came to NZ from Tonga when he was 10 and was raised by his aunt in Mangere. He served with the Tongan army until 1984 but Tongan authorities said no exit visa was issued for him. He had been boarding with the complainant in Gisborne for several weeks before he committed the offence. The woman's husband had gone to Auckland and after the woman and her children had gone to bed, Vakavelo knocked on her door, entered uninvited and asked for her to have sex with him. She refused and, as she went to leave, she
followed him to close the door, carrying her baby. He grabbed her and threw her and the baby on the bed, threatening them with a knife. He dragged the victim to his room, where he produced a machete and threatened her again. When he turned off the light she managed to get free and jumped through the glass pane of a closed window.
